Video Testimonial Contest Standard Terms and Conditions

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER. VOID WHERE PROHIBITED. OPEN TO

ALL ACTIVE MEMBERS OF REALTY ONE GROUP NETWORK EXCEPT REALTY ONE GROUP EMPLOYEES.

1. INTRODUCTION

1.1 This Standard Terms and Conditions (“Terms and Conditions”) shall govern this Contest that is organized by Realty ONE Group, Inc., 23811 Aliso Creek Rd., Ste 168, Laguna Niguel, CA 92677 (“ROG” or “Organizer”).

1.2 A copy of the Terms and Conditions is available via realtyonegroup.com.

1.3 Through this Contest, ROG encourages members of its network to share their video testimonials about their success at Realty ONE Group for a chance to win a prize.

1.4 The Contest will be held between May 2nd 6am PST and May 11th Midnight PST (“Contest Period”).

2. ELIGIBILITY

2.1 Contest is open to all current active members of Realty ONE Group except Realty ONE Group employees. Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.

3. VIDEO TESTIMONIAL SUBMISSIONS

3.1 During the Contest Period text Kuba a video testimonial to 949-881-1111.

3.2 By submitting a video testimonial, the participant shall be deemed to have read, understood, accepted, and agreed to be bound by these Terms and Conditions.

3.3 Only 1 testimonial per participant during the Contest Period will be considered. Submission does not guarantee a win, winner will be chosen by ROG for any reason at its sole discretion.

3.4 ROG will choose 1 prize winner each day among that day’s submissions. Total of 11 winners will get a prize during the Contest Period.

3.5 Prize will be $111 gift card of any vendor, product or service at ROG’s discretion. Prize will be mailed to winner’s mailing address.

3.6 ROG’s decision is final and the prize may not be redeemed for cash value or exchanged.

4. SUBMISSION GUIDELINES

4.1 Your video testimonial must be no longer than 1 minute and answer the following 3 questions:

• What’s your name and what Realty ONE Group office are you with?

• Why did you join Realty ONE Group?

• How are you continuing to be successful at Realty ONE Group?

5. ASSIGNMENT OF RIGHTS

5.1 By submitting a video testimonial and participating in the Contest and in consideration of ROG granting to the participant the opportunity to win a prize, the participant unconditionally and irrevocably:                                                                                                                                     

5.1.1. Consents, grants, assign and transfer to ROG the exclusive worldwide rights (without remuneration to the participant and royalty-free) to use, reproduce and exploit the names, autograph, likeness, photographs, portrait, caricature, silhouette, voice, biography, performance, sound recordings and audio-visual recordings of the participant and/or any part thereof and all other products resulting from the participant’s participation in Contest and participant’s video testimonial and by any means (including without limitation the right to incorporate any other materials thereto) and in all media whether now known or hereafter devised for the purpose of promoting, marketing, publicity or commercial exploitation.                                                                                                                                                                             

5.1.2. Agrees that the personal data of the participant including, but not limited to, name, mailing address, phone name and email address may be collected, processed, stored and otherwise used for the purposes of conducting and administering the Contest and used in the ordinary course of ROG’s business as it sees fit.

6. LIMITATION OF LIABILITY

6.1 ROG, its affiliates, employees, agents, sponsors, vendors, partners, and representatives shall not be liable under any circumstances or in any event whatsoever for any error, omission, delay of any kinds, or any acts related to Contest. ROG is not promising or entering into any agreement to undertake any acts. Without limiting the foregoing or any other provision herein, ROG's total liability for any and all claims, judgements, and awards against ROG shall not exceed the total out-of-pocket expenses incurred by you to participate in the Contest. In no event shall the ROG be liable for any attorneys'; fees, punitive, indirect, incidental, special, and consequential damages.

7. ADDITIONAL TERMS

7.1 If any term or provision of these Terms and Conditions is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Terms and Conditions or invalidate or render unenforceable such term or provision in any other jurisdiction. If any term of these Terms and Conditions is held to be excessively broad or invalid, illegal, or unenforceable in any jurisdiction, it shall be reformed and construed by limiting and reducing it so as to be enforceable to the maximum extent permitted by applicable law in conformance with its original intent.
